While these training materials address the current Fair Housing Act regulations and corresponding best practices, the recent HUD May 2026 memo signals a change in how HUD and the DOJ may investigate or assess cases involving assistance animals. Because untrained Emotional Support Animals are still recognized under many state laws and current established case law, we will continue to recommend our existing best practices. We advise housing providers looking to alter their policies and practices in response to this memo to proceed with extreme caution until clearer regulations and case law are established.  We recommend that housing providers consult with their attorney before altering any existing accommodation policies.
